MEMBERSHIP AGREEMENT
1. PARTIES
This Agreement is entered into between Kulaç Grup, the owner of the website klctak.com (hereinafter referred to as the "SELLER"), and the user who registers on the site (hereinafter referred to as the "MEMBER"). It becomes effective upon the MEMBER’s approval.
2. SUBJECT OF THE AGREEMENT
This Agreement sets forth the terms of site usage, the rules of the klctakclub loyalty program, the non-transferability of membership rights, and the sanctions to be applied in case of misuse.
3. PERSONALITY OF THE ACCOUNT AND PROHIBITION OF TRANSFER (CRITICAL CLAUSE)
3.1. Non-Transferability: The membership account created, along with the points and rights earned, are strictly personal to the MEMBER. The MEMBER may not transfer, sell, rent, or otherwise allow another person to use the account.
3.2. Responsibility: In the event that the account is used by third parties, all legal and financial liability rests with the MEMBER. The SELLER reserves the right to terminate the account immediately upon detecting such a transfer.
4. MEMBERSHIP TERMINATION AND ACCOUNT DELETION PROCEDURE
4.1. Account Deletion Request: The MEMBER cannot unilaterally terminate membership through the site. Permanent deletion of membership requires the MEMBER to contact Customer Service in writing and submit a request.
4.2. SELLER’s Right of Termination: The SELLER reserves the right to suspend or permanently close the membership without prior notice in cases of misconduct or when deemed necessary. The MEMBER cannot claim any rights or compensation due to such action.
5. CODE OF CONDUCT AND SERVICE RESTRICTION
In the following cases, the MEMBER’s access to services will be suspended by the SELLER until the behavior is corrected:
5.1. Inappropriate Profile: Use of usernames contrary to public morals, obscene or offensive profile pictures.
5.2. Offensive Language: Use of slang, profanity, or threatening language towards support staff or SELLER personnel.
5.3. Sanction: In such cases, the MEMBER loses the right to receive support and services until the behavior is corrected.
6. SOCIAL MEDIA LOGIN AND AUTOMATIC APPROVAL MECHANISM
6.1. Automatic Acceptance and Effectiveness: When the MEMBER logs in or creates an account via Google, Facebook (Meta), or other social media platforms using “Quick Login,” this Membership Agreement, Privacy Policy, Marketing/Commercial Communication Consent, and klctakclub rules are deemed fully read, understood, and accepted without any additional action, wet signature, or physical checkbox.
6.2. Consent to Data Sharing: Logging in via social media constitutes full authorization and explicit consent by the MEMBER for the processing and use of data (name, surname, email, profile photo, etc.) shared by the platform with the SELLER under the terms of this Agreement.
6.3. Limitation of Liability: The SELLER cannot be held responsible for technical failures originating from social media platforms, for the MEMBER’s inability to secure their social media accounts, or for unauthorized access to klctak.com accounts resulting from stolen social media credentials.
6.4. Full Responsibility: In the event of social media account compromise (theft), all resulting data leaks, financial losses, and consumption of klctakclub points are solely the responsibility of the MEMBER.
7. LOSS OF klctakclub POINTS AND RIGHTS
If membership is suspended, terminated by the SELLER, or deleted at the MEMBER’s request, all accumulated klctakclub points and benefits will be permanently erased without notice. Deleted points cannot be refunded or converted into cash.
8. SECURITY AND DISCLAIMER (CYBERSECURITY)
The SELLER has implemented all current technical measures such as SSL encryption. However, the SELLER does not accept liability for data loss caused by cyberattacks, data breaches, or force majeure, unless gross negligence is proven. The MEMBER acknowledges the risks of the digital environment upon registration.
9. INTELLECTUAL PROPERTY
All product designs and visuals on the site belong to Kulaç Grup. Unauthorized copying constitutes grounds for legal action.
10. COMPETENT COURT
In disputes arising from this Agreement, the Courts and Enforcement Offices of [City Name] shall have jurisdiction.
11. EFFECTIVENESS
By clicking the “Sign Up” button, the MEMBER is deemed to have accepted all provisions of this Agreement, including the account deletion procedure and conditions of rights forfeiture.
